Water Utility Legal Coordinator

Purpose:
  Under minimal direction and using advanced knowledge plans, directs, and implements enforcement and regulatory strategies in support of the pretreatment, cross connection control, liquid waste haulers, private fire hydrant, environmental, and other regulatory programs designed to protect the environment, the Water Utility's infrastructure and products, and to ensure compliance with Federal, State and local regulations.
Duties, Functions and Responsibilities:
  Essential duties and functions, pursuant to the Americans with Disabilities Act, may include the following. Other related duties may be assigned.
  1. Develop and implement regulatory program policies, procedures and systems to maintain and enhance the organization's adherence and responsiveness to environmental, pretreatment, cross connection control, and other Water Utility issues.
  2. Assist in coordinating, directing, conducting, maintaining, and tracking inspection, investigation, surveillance, and enforcement activities in support of Water Utility regulatory programs (e.g., pretreatment, cross connection control, liquid waste haulers, private fire hydrant, water waste, etc.).
  3. Assist in developing, implementing, maintaining, and tracking the enforcement-related components of the Water Utility's regulatory programs and the pretreatment interlocal agreements with other political subdivisions.
  4. Develop, implement, and maintain the Pretreatment Enforcement Response Plan and Guide and enforcement-related components of the Water Utility's regulatory programs in accordance with federal, state and local regulations.
  5. Participate in audits and inspections conducted by the U.S. Environmental Protection Agency and the Texas Commission on Environmental Quality of the City's regulatory programs (e.g., pretreatment and cross connection control, etc.).
  6. Assist in the review, development, or adoption of new/revised City Code regulations, policies, contracts, interlocal agreements, procedures, technical reports, studies, and legislative bills.
  7. Prepare written reports, documents, memoranda, letters, compliance orders or agreements, notices of violation, citations, warnings, and develop and update complaint language of City Code violations for data entry of Municipal Court complaints.
  8. Conduct administrative and regulatory compliance meetings/hearings, and assess and recommend administrative penalties, restitution, and cost recovery settlements in support of Water Utility regulatory programs.
  9. Coordinate and assist in preparing case file materials (e.g., evidentiary data, photographs, corporate charter research, real estate documents, and other public records) for use in administrative enforcement proceedings, and criminal/civil court hearings/trials.
  10. Assist in filing civil/criminal complaints for alleged City Code violations or environmental crimes, presenting evidentiary data and witness testimony during hearings, negotiating case file settlements, and facilitating closure of litigated cases.
  11. Develop written affidavits for deferred adjudication agreements/settlements, administrative compliance orders, and for the arrest and detention of defendants for alleged violations in accordance with the Austin City Code and assistance from Law Department personnel.
  12. Attend City Council, Board, Commission Meetings, etc. as a City/Department staff representative.
  13. Assist in the development of new/revised interdepartmental or interagency protocol or procedures.
  14. Prepare and conduct presentations to educate and communicate project and program information to internal and external customers.
  15. Participate in and/or lead regulatory program-related city, regional, state, or federal initiatives, task forces, and committees.

Minimum Qualifications:
 
  • Bachelor's degree in Natural Science, Environmental Science, Life Science, Political Science, Engineering, Public Administration, or related field, plus six years of related experience.
  • A Graduate's degree may substitute for two years of the required experience.
Licenses and Certifications Required:
 
  • Current Texas Class "C" Driver's License
